End User License Agreement

1. Acceptance

By downloading, installing, or using VE3FGH's Deck ("the App"), you agree to be bound by this Agreement. If you do not agree, do not use the App.

2. License grant

The developer grants you a personal, non-exclusive, non-transferable, revocable license to install and use the App on Android devices you own or control, solely for its intended purpose: remotely operating amateur radio equipment that you own.

3. Amateur radio licence and regulatory compliance

You must hold a valid amateur radio licence issued by the regulator in your country (in Canada: ISED; in the United States: the FCC; elsewhere, the applicable national authority) to use the App's transmit functions.

You are solely responsible for:

Identifying your station in accordance with regulations.
Operating only on frequencies and modes your licence class permits.
Complying with power limits, band plans, and all applicable rules.
Ensuring your station is configured so that remote operation cannot cause harmful interference or out-of-band transmission.

The App is a remote-control tool. Every transmission it initiates is legally your transmission.

4. The Deck Bridge (PC software)

The App requires companion "bridge" software running on a Windows PC that is physically connected to your radio. That software is provided under the same terms as this Agreement. You are responsible for the security of the network path between your device and your PC (for example, keeping Tailscale access limited to your own devices).

5. Restrictions

You may not:

Reverse-engineer, decompile, or disassemble the App, except where such restriction is prohibited by law.
Redistribute, sell, rent, or sublicense the App or the bridge software.
Use the App to operate a station you are not authorized to operate.
Remove or alter any notices or branding.

6. Ownership

The App, the bridge software, and all associated materials are the property of the developer and are protected by copyright and other intellectual property laws. This Agreement grants you no ownership rights.

7. Third-party services

The App can optionally connect to third-party services you configure — including QRZ.com for callsign lookups and log uploads, and pskreporter.info for spot reporting. Your use of those services is governed by their own terms, and you are responsible for the API keys or credentials you enter.

8. Privacy

The App collects no personal data and sends nothing to the developer. See the Privacy Policy for details.

9. Disclaimer of warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE", WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE DEVELOPER DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. THE DEVELOPER DOES NOT WARRANT THAT THE APP WILL OPERATE WITHOUT INTERRUPTION, THAT IT WILL CONTROL YOUR RADIO AS EXPECTED, OR THAT IT WILL NOT CAUSE UNINTENDED TRANSMISSIONS. YOU USE IT ENTIRELY AT YOUR OWN RISK.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, OR RADIO EQUIPMENT; INTERFERENCE OR ENFORCEMENT ACTIONS BY REGULATORS; OR ANY OTHER LOSS ARISING FROM YOUR USE OR INABILITY TO USE THE APP, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

11. Indemnification

You agree to indemnify and hold the developer harmless from any claim, damage, or expense — including regulatory fines — arising from your operation of a station using the App or your breach of this Agreement.

12. Termination

This Agreement is effective until terminated. It terminates automatically if you breach it, at which point you must cease all use and delete the App and the bridge software.

13. Changes

The developer may update this Agreement from time to time. The current version will be posted here, and continued use after a change means you accept it.

14. Governing law

This Agreement is governed by the laws of the Province of Ontario and the laws of Canada applicable therein.

15. Entire agreement

This Agreement, together with the Privacy Policy, is the entire agreement between you and the developer concerning the App.
